JOHANNESBURG – Suspended Gauteng Health Head of Department Dr Barney Selebano is expected to find out on Wednesday morning whether he will be forced to testify at the Esidimeni arbitration hearings next week.

Selebano is expected to appear before a judge at the High Court in Johannesburg where he has made an application to have a subpoena against him dismissed.

He is one of three key players involved in the Esidimeni project which saw 143 mentally ill people lose their lives.

The State wants Dr Selebano to appear before the arbitration hearings next Monday.

Werksman Attorneys – which represents the State at the hearings – subpoenaed Selebano a few weeks ago, telling him he would be forced to give testimony on 4 December.

However, the suspended Gauteng Health HOD is fighting the subpoena, saying he fears that he will incriminate himself and affect the outcome of an internal disciplinary hearing levelled against him.

Today, a High Court judge will decide whether Selebano’s case has legal ground.
